While this may seem invasive, it’s a fairly common practice and becoming more mainstream every year. This process involves forking over the physical phone to a technical expert for a few hours while they extract all of its messaging data (including any deleted texts). With so many dozens of third-party tools to choose from, you’ll need to do thorough research in order to make sure you’re purchasing the one that has all the features you need. There’s also something to be said about the time it takes to choose a tool that’s best for you. For instance, if an employee catches wind of the discovery process ahead of time and tries to delete evidence from his or her phone before the extraction, you could unknowingly be producing something that’s been tampered with. If your tool doesn’t produce deleted text messages, you might increase your risk of spoliation. Some of the even more basic tools like SMS Backup+ cost less than five bucks. You can get Decipher Tools or its competitor Droid Transfer for a one-time purchase of $30. Most of them are relatively inexpensive, too. Unlike the manual copy and email process, this method is far more defensible in a court of law. Like the manual copy and email process, third-party apps boil your export down to a process that only requires a few simple steps (in addition to downloading the tool itself). While some of these applications can’t help you procure deleted text messages, many of them (such as Decipher Tools) can maintain their own message history on your PC or Mac, reducing your risk of spoliation. The format won’t make much of a difference, though, since the discovering party will likely either be a) reading the file with their own two eyes, or b) utilizing an all-purpose culling tool like Logikcull to parse the data. Some of them will create a PDF file for you to share or save, while others may export to RTF or even create an email backup. The actual file product will differ from app to app. In today’s world, you can find an app for practically anything, and exporting text messages from a phone is no exception.ĭevelopers like Decipher Tools have come up with detailed technological solutions that make it easy to export both iPhone and Android text messages. Third-Party Apps and Software for Producing Text Messages Basically, this is not the best method to use. On top of that, the process is incredibly time-consuming, and can’t produce deleted text messages. There’s too much room for messages to be doctored, or excluded outright. Consīecause it’s a manual process, it’s highly unlikely that the ESI you produce by copying the messages in a conversation will ultimately be defensible in court. This method is convenient and doesn’t require the use of any third-party apps, so you won’t have to spend time downloading anything (or paying for an add-on). At that point, you can email the conversation to yourself or someone else. With an iPhone, saving an entire text message conversation boils down to a fairly simple four-step process, and that process is largely similar for Android phones. Manually Saving and Producing Text Messages Here’s a rundown of the pros and cons of each. Hopefully you’ll never end up in this situation, but if you do, there are a variety of methods you might consider using in order to produce them for review. The judge told Heinz to interview 10-12 custodians in order to determine whether they’d used their personal phones to text about company matters, and produce those texts to the defendant if so.īut the practice has become more and more common in recent years, and it’s gotten to the point where businesses may need to start widening the scope of their litigation holds to cover text messages on company phones - or else risk spoliation. One of the earliest cases that helped set precedent was H.J. The discoverability of text messages is nothing new. When it comes to litigation and investigations, text messages are “electronically stored information” (ESI) subject to discovery by opposing parties. If you’ve ever used your phone to send a text message for business purposes, it could suddenly and unexpectedly become a mouthwatering eDiscovery target for opposing legal teams. Think your text messages are private? Think again. Don’t miss our overview on how to collect email data for discovery across a wide number of common platforms. This post is part of our “How to Export and Review” series.

I played on mobile and the screenshots reflect that, but the Steam version is set up a bit differently to better take advantage of the extra screen space. One last note here, the Steam version has a slightly different interface than the mobile versions. There is a much needed undo button, thankfully! This is crucial when learning the game. This all comes together to work quite well. The game offers multiple viewing options for the main gameboard so you can find the one that fits you best. Like other games with this much going on, there are sub-menus for things that don’t fit on the main gameplay screen. With so much going on, some of the click areas appear to be fairly small, but I have not had any issues getting incorrect tabs during my time with the game. Overall, it is a nice balance of old and new, and works quite well all around.Ĭontrols work via click-and-confirm. The menus look more polished than in their previous games while maintaining the familiar layout. It has been revamped a bit for Gaia and remains as functional as always. Gaia Project is a Digidiced game which brings the typical Digidiced layout. I’m not convinced that I fully understand even now, but I’m getting there.Ī huge footnote to this section is that this game is the successor to Terra Mystica and anybody who has played that (which is NOT me, to be clear) has a big leg up in learning Gaia Project. Between all of the above I was able to get an okay handle on the game, but it took a few times actually playing to really start to understand how it all comes together. On top of all of that, the game frequently offers pop ups while playing to help clarify things.Įven with all of that, this game is still a beast to learn. They clearly know this and provide a full tutorial, link to a YouTube video, as well as links to download the full rulebook and faction rules. This makes teaching the game a huge lift for Digidiced. Personally, I wholeheartedly disagree with BGG’s assessment that Through the Ages is a heavier game than this. That minor quibble doesn’t change the fact that Gaia Project is one of the heaviest games to get the digital treatment. It isn’t one for me on first pass, but I've been intrigued enough to keep trying. Massive game, variable player powers and setup, economy building, etc… You know if this is a game you might enjoy or not. On that front, quite a few aspects of the game are variable, beyond the high number of factions, so each game will have a distinct feel and a big portion of the game is surveying the initial game board and formulating a plan based on how the current game is set up. There are variable scoring goals which change from game to game, these give players something concrete to aim for throughout the game and the variability adds to the replay value. The game strolls along over six rounds and some final scoring takes place when it’s over. Terraforming, inhabiting, and building on planets is a major point of emphasis here. This is the act of using a specialized resource to convert an entirely uninhabitable planet into a slightly more habitable planet. Rather than going into a deep dive into the game, I will explain the term important enough that they decided to name the game after it Gaia Project. The main crux of the game is building your engine to make sure you can produce everything you need to terraform and expand your empire. As you would expect, each faction has their own strengths and weaknesses to leverage or exploit. With that out of the way, Gaia Project tasks players to pick a faction and plot their course to exert the most control over a mostly unexplored region of space. I suspect you won’t mind as most readers just want to know if the app is functional and has the features you want (spoiler: it is and and does), but I did want to preface things a bit in case you were expecting a classic Pixelated Cardboard 1,000 word explanation section. Okay, that’s being overdramatic, but the point is that I can learn a game, play a fair number of times, not *really* get all of the intricacies, but still write a review. More recently I’ve fallen into the approach of accepting defeat and moving on. I’ve tried different routes over the years including playing until my thumbs were numb until I “got” the game. This, unsurprisingly, happens every now and then as I’m reviewing these apps. I’m noting my initial reaction here to be sure to set the stage in letting you know that Gaia Project is not my preferred type of game. Gaia Project feels like *exactly* what pops into my head when I think of “heavy board game.” It’s got the space exploration theme, economic mechanics, exploration, trading, etc… This game is absolutely wild laid out on a table in physical form. It's pretty easy to do with a mobile app. If you want to make journaling your daily practice, you need to keep track of your progress. Journaling helps you get where you need to go. With an electronic journal you can better protect your privacy through passwords, and nobody will read your journal against your will. But this is not the best way to secure your entries. You can always hide your notebook from others. For journal writers privacy is often the most important concern. Since you're writing from your heart, you typically don't want anybody to read what you wrote. The real value of journaling comes with being open and honest with yourself. With a mobile app you can export your pages into PDF, print them, and even share with somebody. Sometimes you may use a journal to make plans for the day, think about a project, or draft some notes. Also not all your daily writing might be a stream of consciousness. But if you don't follow this rule at all times, you might actually want to read what you wrote in a few days to see the situation from another angle. If you read the book the "Artist's Way" where Julia Cameron introduces the term Morning Pages as a way of journaling, you should know that you aren't supposed to go back and re-read your pages. If you prefer typing on a computer, you can use apps like Ommwriter that blocks off all the notifications you receive. However, you can always turn off notifications on your phone. When you type on your computer or a mobile app, you get distracted by extraneous apps, emails, and notifications. One of the biggest advantages of paper notebooks is that they don't interrupt writing. To focus on writing you need to cut out distractions. Journaling requires a lot of mental energy. Turn off notifications to eliminate distractions It's also easier to search for specific entries using digital tools.ģ. Your smartphone is always with you, and if you do forget it somewhere you can recover your entries. You also don't have to worry about forgetting your notebook at home when you go on holiday. When you type, however, you can create backups of your journal and access what you've written from anywhere. But a paper notebook can get lost pretty easily. Some of your thoughts and memories that you pour on paper are very important to you. This is especially beneficial for aspiring writers who use journaling as a regular exercise to develop their own voice in writing. Mobile apps can send you notifications reminding you to write every day. The main benefit of using a mobile app for journaling is that it helps you keep up with a regular writing habit. Regularly jotting down your thoughts improves your personal well being, and gives you time for self-reflection. Journaling is something that you need to do on a daily basis. If you grew up in a digital age like I did, and you're comfortable with using technology for coping with your life, than the practice of journaling with the help of a mobile app is something you might already be doing.ĭespite the pen being mightier than the keyboard, how about we make a defense of journaling apps and list the benefits these tools provide?Ħ things you can do with the help of mobile technology There are studies that say writing by hand stimulates certain cells in your brain, and as a result you give more importance to the stuff that you’re actively focusing on at the moment.īut does this mean that it’s impossible to focus, express your feelings, be creative or come up with ideas when you type? Not quite. You put more thinking when writing by hand than typing. Writing by hand connects us more intimately to our thoughts, and paradoxically is more efficient in terms of getting in touch with ourselves and opening the path to our most authentic selves and the day at hand.” "Typing Morning Pages may give us more speed - but will give us less depth. Julia Cameron, the author of the book "The Artist's Way" who coined the term Morning Pages – a daily journaling practice – makes this pretty clear: I know some of you would argue that journaling by hand is the right way to do it. Technology makes our lives comfortable and convenient. Unless you prefer journaling by hand, it would be hard for you to remember when was the last time you actually wrote something using a pen and paper. And most of your writing is on your phone. Emails and social apps replaced handwritten letters. And before you go to bed you check out your news feeds on social media.īooks became digital. When you need to buy groceries, you use your smartphone to make a shopping list. You spend all day sitting in front of your computer doing your job. While commuting to work you're listening to music streaming from your phone. You wake up at the sound from your smartphone that gets louder until you push stop. There are third-party encryption tools as well. Apple iPhones are encrypted by default but you need to use a PIN or password to secure the device. This is the way Windows Bitlocker and Macintosh FileVault 2 work they are included in the operating system but have to be turned on. Recent Android-powered devices have encryption built into the operating system but not turned on by default. You set the encryption and, except for using a password to turn off the encryption, and turning it on again when you shut down your system, you can forget about it. When you have applied encryption to the device, it is a matter of “set and forget”. I do not need to be able to use Windows to copy files and other data off your hard drive.Įncryption is a complex security technology. If we return to the box, a Windows password leaves your hard drive outside the secured box. But that only secures access to the operating system and the applications in it. Some lawyers think that they have secured their files by using a Windows password. When your whole hard drive is in the box, then nothing – from your Windows wallpaper to your client files – can be accessed without the decryption password. If you think of encryption as a box into which you’ve put your data, then you can visualize how, when the box is closed, no-one can see what is in the box. In fact, Windows is a great example of how the encryption works. This is different from your operating system password in Microsoft Windows. In practice, you type in a password on your smartphone or tablet or on your computer when it starts up. While it is decrypted, anyone can access it on the device. For you or anyone else to access the data, a password is needed to decrypt the data. When the encryption is turned on, it hides your data within whatever container is encrypted. That may seem counter intuitive if you do not understand how encryption works. Both provide full disk encryption so that as soon as you turn off your computer, you are protected. Now you just purchase a business version of Windows with its BitLocker encryption built in and turn it on. It was once tricky to encrypt a Windows computer or a smartphone but that has changed in the last few years. EncryptionĪny device containing client information should be encrypted. It revolves around just a few basic functions that need to be used properly and consistently. There’s nothing magical about law practice security. A criminal may not be able to breach a corporation’s security, but they may be able to get through a law firm’s and get access to the same information. It is one reason that law firms have been called the soft underbelly of cyber security. One big difference is that they tend to hold valuable information on the part of other people. The legal profession is largely solo and small law firms and face the same challenges that other small businesses do. Before we talk about more of the technology in a law practice, let’s look at how you start to secure the information you are gathering. Follow us on Facebook, Twitter and Telegram.
